Standard Booking Terms & Conditions
1. INITIAL RESERVATIONS
We accept initial reservations by telephone, fax or email for the current and following year only.
2. THE BOOKING FORM Reservations will be confirmed upon return of the fully completed Booking Form, the deposit or full payment of the rental charge according to the schedule set out in paragraph 4. Until that time no contract or agreement will be considered to exist between us. If significant changes need to be made in the Booking Form after the reservation has been confirmed, an amended set of forms must be completed and returned.
3. THE PARTY LEADER
The Party Leader is the person or agency who holds the booking, to whom all correspondence and invoices are addressed and who is responsible for the rental.
4. PRICE & THE PAYMENT SCHEDULE
The price quoted on the rental invoice is the contractual rental price (this will be referred to as the Invoice Price). The payment schedule for the rental price is as follows: • A deposit of 25% of the total Invoice Price is payable immediately upon confirmation of booking. The balance payment is required in cash upon arrival, unless stated differently on your booking confirmation. We accept payments in Euro via bank transfer. Credit/debit cards payments are processed in Euros only via PayPal. A 5% fee will be applied to all PayPal transactions to cover fees and processing costs.
5. SECURITY DEPOSIT Depending on the property, we will ask all guests to provide a small security deposit from €50- €200 on arrival at the property. This can be in the form of cash or cheque. The Security Deposit, less any applicable deductions will be returned to you on your departure. In the event that the damage sustained to the property exceeds that amount on deposit, Sicily Rental and sales will request an additional payment to be made to cover these costs prior to departure.
6. GROUP SIZE AND COMPOSITION
The number of people staying at the villa throughout the rental period must never exceed the number of sleeping places indicated in the property description, without prior agreement from us. Should the composition of the party as detailed in the Booking Form change prior to the rental period, clients are asked to notify Sicily rental and sales promptly in writing.
7. LETTING PERIOD
The letting period is clearly stated on both the Booking Form & Confirmation Form. Depending upon the property and time of year, Sicilian Experience offer flexible letting periods wherever possible.
8. ARRIVALS & DEPARTURES Clients are expected to arrive at the property between 4:00pm and 10:00pm on the first day of the rental period. If a different arrival time is anticipated, Sicily Rental and Sales must be notified in writing well in advance of your arrival date, so we can ensure we are available to meet you at the property. Upon arrival, clients should inspect the property and ensure that they fully understand the use of any appliances, equipment and utilities. Clients are expected to vacate the property at 10:00am on the final day of the rental period. Where ever possible Sicily Rental and Sales will try and be flexible with actual departure time. Only in the cases where the accommodation is occupied for the following night will we insist on an 10:00am departure time, in order to make the property available for the next guests.
9. SUBSTANTIAL AMENDMENTS OR CANCELLATIONS BY YOU
Substantial amendments to bookings, such as a change of dates or properties, or cancellations must be conveyed in writing and are subject to penalty charges as follows: Period before departure Cancellation charge (% of total invoice) Up to 40 days before arrival Deposit • Notices of amendments requested more than 40 days before the first day of the rental period are subject to an administration charge of €20.00 plus any difference in the cost of the revised arrangements. • Bookings may not be deferred to the following year. • Bookings are not for re-sale by the party leader to any third parties under any circumstances.
10. AMENDMENTS OR CANCELLATIONS
BY US We undertake to notify clients in the unlikely event that we are forced to make changes to their booking. Should a property become unavailable for reasons beyond our control, we will do our utmost to find an alternative property in the same area and of a similar description, and reserve the right to transfer your booking to that property. Should no similar or suitable properties be available, we will refund the full amount paid to us for the rental, but we will not be liable for cancellation charges pertaining to travel arrangements.
11. PROPERTY DESCRIPTIONS
We have visited and inspected each property. The descriptions contained in our website were accurate at the time of publication and made in good faith. Please check the description on our web site as this should be considered the correct description. We decline all responsibility for any modifications made by the owners without our knowledge, or for construction or alteration of the landscape in the vicinity of the property. Clients will be notified in writing of any changes that are made to a property or anticipated/current construction projects in the area if we are made aware of them, and the description will be altered accordingly. Access roads to rural properties may be rough, twisting and/or bumpy - drivers of low-slung cars should check with Sicilian Experience to ensure that access is reasonable.
12. CHILDREN’S SAFETY AND EQUIPMENT
A number of properties are identified as being ideal for families with small children. Our recommendations are based on our inspection of the properties, the positive experiences of past clients and the owner's willingness to accept children at the property. Clients with infants and small children should check with Sicilian Experience if a cot or high chair is available. These may not conform to safety standards and are used at the client's own risk. For sanitary reasons bedding for cots is not supplied.
13. HOUSEHOLD AMENITIES
Properties are supplied with linens, towels and table ware sufficient for the number of guests indicated in the Booking Form. Fresh linens and towels are provided weekly. Should problems arise with the delivery of water, gas, electricity or telephone services, the owner/caretaker of the property will do their utmost to remedy the situation but we cannot accept responsibility for non-delivery due to circumstances beyond our control.
Clients' pets are not accepted at any property unless noted in the description and your intention to bring a pet to the property should be included on your Booking Form.
15. SWIMMING POOL
Swimming pools by their very nature carry their own inherent risks. You must ensure that you and all members of your party take great care when using or being near any swimming pool(s) at the property where you are staying. You should for example make sure you and all members of your party are aware of the depth(s) and layout of the pool by physically checking it prior to use and that all persons walk rather than run around or near the pool. You must ensure that no one dives into the pool at any time or enters it while under the influence of alcohol. You must check the pool every day before use and immediately report any apparent defects. Many pools in Italy are not fenced. If you require a fenced pool, you must inform us of that requirement before you make your booking to allow us to locate one for you. Whether the pool is fenced or not, children must be supervised at all times by a responsible adult. We and the property owner have no liability for any death or personal injury arising from use of or connected with the swimming pool except to the extent such liability cannot legally be excluded. We and the property owner have no liability for any death or personal injury which results from failure to comply with the above requirements.
16. GROUP BEHAVIOUR
The property will be in a clean and well-maintained state when you arrive, and it is expected that you and your party will keep them so throughout the rental period. If the property has not been left in an acceptable state, Sicilian Experience may invoice you an additional Euro 50.00 for the extra cleaning and tidying required. This charge will only be levied in extreme circumstances. The Party Leader is responsible for the decent behaviour of his party. Should the party behave in a manner that is not acceptable, Sicilian Experience has the right to ask you to vacate the premises. No camping is permitted on the property grounds.
17. PROBLEM RESOLUTION AND DAMAGES
If a problem occurs at the property, it is the client's responsibility to contact Sicilian Experience promptly so that we may take the action required. The Party Leader is liable for all damages caused by any member of the party to the property, its contents or grounds and for the loss of any articles belonging to the property. The cost of repairing any damages caused by the party or replacing of any articles lost will be deducted from the Security Deposit, with any additional costs invoiced to the Party Leader. These are expected to be paid prior to departure.
18. TRAVEL INSURANCE
By returning your completed Booking Form you are declaring that you hold a valid travel insurance policy as generally available in Europe. For non-European citizens we highly recommend that you obtain coverage for medical and personal liability, as well as loss of luggage, monies and repatriation.
19. LAW AND JURISDICTION
Your contract made under the terms of this agreement is subject to Western Australian Law and Jurisdiction. From the 1st July 2010 the Italian Law and Jurisdiction. 20. RESPONSIBILITY By completing and returning the Booking Form, you and all members of your party acknowledge full awareness of these Booking Conditions and agree to accept and abide by the terms stated. We act as booking agents on behalf of named owners of the properties on our website, and as such your rental contract is with the relevant owner. We do not have any obligation to compensate you for any personal injury, death, loss or damage of whatever nature suffered by you (or by any member of your party) save to the extent caused by our own negligence.
